Supreme Court Declares Safe Footpath Access a Fundamental Right

The Supreme Court has delivered a significant message on public accessibility and pedestrian safety, emphasizing that urban infrastructure must place people at its center. The observation reinforces that public spaces are not only about movement but also about ensuring dignity, safety, and equal access for every citizen.


The Court stated that the right to walk freely and safely on footpaths is a fundamental right and forms part of the right to life guaranteed under Article 21 of the Constitution. It underlined that footpaths exist primarily for pedestrians and that encroachments or obstructions compromise both safety and the ability to move without difficulty.


The Court also highlighted the need for pedestrian infrastructure to remain accessible for all, including persons with disabilities. It stressed that authorities and state agencies must take necessary steps to maintain safe, functional, and inclusive public pathways.


With this observation, the Court has placed renewed focus on pedestrian-first urban planning and civic responsibility. The ruling is expected to strengthen efforts toward creating public spaces that are safer, more accessible, and better suited to everyday movement.
